Terms and Conditions of Service (TCS)
1. Scope of Application
These Terms and Conditions of Service (TCS) apply to all deliveries of Edition Biographæa ® to clientele, which are carried out by the Gerhard Reisch Verlag (hereafter referred to as GRV) – a dedicated enterprise of the registered non-profit Gerhard Reisch Stiftung (viz. Foundation) in Germany (hereafter referred to as GRS) – on behalf of the Makers. A client is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.
2. Contractual Partner
The purchase contract is concluded with biographaea.com/shop, Edition Biographæa, Gerhard Reisch Verlag, Badener Ring 15, 88633 Heiligenberg, Germany : Domicile of the GRS as registered with the Regierungspräsidium Tübingen, Referat 14, Konrad-Adenauer-Strasse 20, 72072 Tübingen, Germany.
3. Conclusion of Contract
The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.
By clicking on the "PAY NOW" button, you place a contractually binding order for the products listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail after receiving your order.
4. Right of Cancellation
If you are a client (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of cancellation in accordance with the statutory provisions.
If you make use of your right of cancellation as a client, you must bear the direct costs of returning the goods, including loss and shipping damage insurance and shipment tracking for your own protection.
In all other respects, the provisions set out in detail in the following cancellation policy apply to the right of cancellation.
Cancellation Policy
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you have taken possession of the goods.
To exercise your right of cancellation, you must inform us on our website www.biographaea.com by submission electronically of a clear statement of your decision to cancel this contract. If you make use of this option, we will send you an e-mail confirming receipt of such a cancellation.
To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.
If you withdraw from a contract, we shall reimburse all payments received from you, excluding any special discounts and our original costs of free worldwide delivery including insurance and tracking and supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract
You must return or hand over the goods to Leonhart Druck GmbH, Industriesiedlung 1, 84140 Gangkofen within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you provide irrefutable proof of dispatch the products before the period of fourteen days has expired.
You must bear the direct costs of returning the goods, including loss and shipping damage insurance and shipment tracking for your own protection.
We may refuse to refund you until we have received the goods back in perfect condition. In the event that your return shipment is lost or damaged, we will assume that you have used packaging and return shipping methods including loss and damage insurance and tracking for your own protection.
For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; only in exceptional cases will you be charged fees for this repayment.
You are liable for any loss in value of the products that is attributable to unnecessary handling on your part, including your chosen return shipment methods, after thoroughly checking the condition, properties and functionality which reveals demonstratable damage to the products.
5. Prices and Dispatch Services
The prices quoted in biographaea.com/shop include statutory VAT and other pricing elements.
Quoted prices include charges for secure worldwide delivery including insurance and tracking. If additional extraordinary shipping costs have to be charged, you will be clearly informed by email and your confirmation by email will be requested (see §4.).
Before dispatching your order, our payment service provider must confirm receipt of your prepayment exclusively in Euros without deduction of any payment or bank charges on your part. Otherwise there are no further taxes or charges. The GRS is freed of disclosure of sales tax in accordance with §19 para.1 UstG.
Worldwide delivery is carried out exclusively via our selected dispatch services. Settlement of all possible import duties is solely the responsibility of the client.
You will receive notification of estimated delivery times and tracking information by email. We cannot accept responsibility for any despatch service discrepancies or delivery service damages that may occur through our selected shipping services.
6. Payment
Payment must be made solely in advance (see §5.) through our specified payment service providers.
The options for your payment methods are specified by our payment service providers. Without confirmation of receipt of your payment by our payment service providers, your order will automatically be categorised as unsuccessful; you will be informed accordingly by email.
7. Reservation of Ownership
The products remain our property until payment has been received in full.
8. Warranty for Material Defects
The proprietor of biographaea.com/shop is liable for material defects of products in accordance with the applicable statutory provisions, in particular Section 434 of the German Civil Code.
9. Dispute Resolution
The EU Commission has created an internet platform for the online settlement of disputes. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available at the following link: www.ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The sole place of legal jurisdiction is the registered office of GRS in Germany.
Severability Clause
Should any Terms and Conditions of Service (hereafter referred to as “Provisions”) of a contract concluded via www.biographaea.com/shop be or become invalid, void or unenforceable, they shall not affect the validity of the remaining Provisions. In place of the invalid/void Provisions, the parties shall agree on a Provisions that come as close as possible to the intended purpose of the invalid/void Provisions. This also applies to the correction of any contractual omissions.
